Terms and Conditions for In-App Purchases (SNIZ PRO)
These Terms and Conditions apply exclusively to the purchase of optional, paid add-on features ("SNIZ PRO") within the mobile application SNIZ — Tagesgeld-Hopping ("SNIZ", the "App"). They supplement Google Play's and Apple App Store's own terms of use, which apply in addition and are not replaced by these Terms.
1. Scope and Contracting Party
The contracting party for the purchase of SNIZ PRO is:
Suther Kommunikationsdesign
Owner: Samuel Suther
Am Aschenkrug 72, 41169 Mönchengladbach, Germany
E-mail: info@suther.de
— not Google LLC or Apple Inc. Google Play and the Apple App Store act exclusively as payment processors (see section 4).
2. Description of Services
SNIZ PRO comprises optional, exclusively digitally provided add-on features of the App (e.g. encrypted backup export/import for device transfer). These are digital content within the meaning of § 327(1) BGB (German Civil Code), not provided on a physical data carrier. The specific scope of features and price are shown to you in the App before purchase.
3. Conclusion of Contract and Prices
The contract is concluded once you complete the purchase via the native purchase confirmation of Google Play or the Apple App Store. The price, including applicable statutory VAT, is shown to you before you complete the purchase.
4. Payment Processing
Payment is processed exclusively via Google Play Billing or Apple In-App Purchase. We never gain access to your payment instrument data (e.g. credit card numbers). For details on data processing related to the purchase, see our Privacy Policy, section 5.
5. Provision and Right of Withdrawal
As a consumer, you generally have a statutory 14-day right of withdrawal (§ 355 BGB). Since SNIZ PRO is digital content provided immediately upon purchase, this right of withdrawal expires early if, before provision begins, you expressly consent to us beginning performance before the withdrawal period ends, and you simultaneously confirm that you thereby lose your right of withdrawal (§ 356(5) BGB). We obtain this consent via a separate confirmation step within the App, before the actual purchase is triggered via Google Play/Apple App Store.
If this explicit confirmation is not given, your statutory right of withdrawal remains unaffected.
6. Refunds
Refunds are processed exclusively via the respective refund function of Google Play or the Apple App Store. We ourselves have no technical access to payment processing and cannot issue direct refunds. For questions, contact us at info@suther.de.
7. Liability
We are liable without limitation for intent and gross negligence, and under the provisions of the German Product Liability Act. For slight negligence, we are only liable for breach of a material contractual obligation (cardinal obligation), limited to the damage typically foreseeable at the time the contract was concluded. Liability for slight negligence is otherwise excluded.
8. Changes to These Terms
The current version is always available at sniz.app/terms. Material changes will be communicated as part of an App update.
9. Governing Law, Jurisdiction
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer resident in another EU member state, the mandatory consumer protection provisions of your country of residence remain unaffected.
